CBP seized Max Blumenthal’s phones after he returned from reporting in Iran while leaving his laptop and cameras behind. That selection points directly toward his contacts, sources and private communications. The phones were returned less than 24 hours after Jenin Younes and ADC sought emergency relief. A federal judge then ordered the government to account for who possessed them and what was done with them. The border-search exception is being used as a surveillance weapon against political journalism. Jenin’s case could determine whether the First and Fourth Amendments still reach the airport.
