Wilson says, “…All the Joint Action Forum members, which was constituted specifically for these FCRA issues, with one voice have asked for either the withdrawal of the FCRA Bill and repeal of Section 15 of the 2010 Act, or to refer it to the Joint Parliamentary Committee. In the context of the suspension of the Indus Water Treaty, the demand made by Jammu and Kashmir Chief Minister Omar Abdullah to the central government for priority-based use of water to meet his state’s needs is entirely justified and reasonable. Similarly, Punjab, being a riparian state, has the full right to first utilize its river waters to fulfill all of its own requirements, including agriculture. Only after that should the right be granted to levy charges or compensation on the water supplied to non-riparian states. I rise to oppose the introduction of these three bills that provide legal framework for the removal of the PM, CM, Union Ministers and Ministers in States and UTs. This bill is squarely destructive of the basic structure of the Constitution. There should be rule of law: you are innocent until proven guilty. This bill turns that fundamental maxim of jurisprudence on its head. It makes an investigating officer the boss of the Prime Minister of India. The second ground on which I oppose this bill is that it violates Article 21. The due process clause: FIR, arrest, charge sheet, and even framing of charge do not in any manner substantiate guilt. In fact, you plead not guilty only after charges are framed against you. This bill turns the fundamental jurisprudence of Article 21 on its head. Number three. It distorts parliamentary democracy, which is part of the basic structure, by displacing the will of the people through mere custody bereft of a judicial determination. This bill opens the door for political misuse by instrumentalities of the state, whose arbitrary conduct has been repeatedly frowned upon by the Supreme Court. And finally, it throws all existing constitutional safeguards to the winds: collective responsibility, judicial review, no-confidence motion and disqualification conviction. I agree with Nana Chiraahene, Barima Mintah Afari II that the sanctity of the December election must not be sacrificed—the Electoral Commission has the responsibility to guarantee that sanctity. Our repeated calls on Jean Mensah and the Commission to ensure fairness and free elections continue to be rebuffed, but as Nana Chiraahene stated, the Commission must be careful to avoid plunging this country into chaos due to its avoidable mistakes and actions. The call for a forensic audit of the voter register is not a demand of the NDC alone. It is a legitimate demand from all peace-loving Ghanaians who desire a free, fair, and peaceful election on December 7. The demand for the audit must and should unite us all in our quest for electoral integrity. #ResettingGhana #LetsBuildGhanaTogether #MahamaForPresident
