The framers meant birthright citizenship for the children of freed slaves. “Subject to the jurisdiction” has teeth. It means allegiance to the United States. Ambassadors’ kids born here? No citizenship. Invading armies’ kids born here? No citizenship. American Indians did not fall under U.S. jurisdiction for this clause. Congress granted citizenship by statute. It requires two things: birth here and allegiance here. “Subject to the jurisdiction” means loyalty to the United States. Not lawbreaking aliens exploiting loopholes.
