To make the stop, the cop needed “reasonable suspicion.” Simply having a bottle in a bag is NOT reasonable suspicion. To establish “reasonable suspicion” the cop used the “smell of alcohol.” He didn’t smell alcohol. He lied. Thus: an illegal detainment.

Some babies are complaining that the subject “baited” the cop. But exposing that cops either don’t know the laws, or are willing to violate the law is a public good. This cop will think twice before violating reasonable suspicion protocols, again.

Y’all can save me with the whole “entrapment” bullshit. They’ve got 10 plainclothes out there right now in Hollywood leaving unattended cars w/engine running in front of homeless in hopes of baiting them Whine to someone else about the cop looking stupid.

See, they need to not let that slide. If he says he smelled alcohol, and there was no alcohol, then he needs sent for a psych eval because he's having olfactory hallucinations and might have a neurological problem. Should need a full workup before he can return to work.

I hope this gets played at every trial he tries to testify at. NOT A CREDIBLE WITNESS!!!

@AntifaMillChi one of my favourite things about Germany is that it is 100% legal to "drink in public." Beer is sold in kiosks on subway train platforms so people can enjoy a beverage while traveling safely to their destinations 😃🍻
