These TikTok finance influencers need to go. This is simply not true and he doesn't know what he's talking about. Beneficiaries receive a step-up in cost basis on appreciated assets, regardless of whether they are held in a revocable living trust or not. So dumb.

This is not true. While a living trust will generally help you avoid probate, which is typically a good thing, you can get the same step up in basis by leaving the property in your Will.

This is uneducated advice. See Section 1014 of the Code. Leaving in a Will (or without via intestacy) wil trigger a similar step up. Parents can also sell and take advantage of Section 121 for themselves, exempting gains. TikTok tax fail.

Why would they go to probate if there is a will?

Unless you are in the top 10% of people most will not need to worry about this. Inheritance tax at the fed level starts at $13.8 million. Each state has its own level but almost all are very high starting levels. Just talk with an estate lawyer and get the options best for you.
