This is the Amazon Loophole. They use third-party contractors to avoid taking direct responsibility for their drivers' mistakes. This couple deserves the full repair cost.

The driver doesn't work for Amazon and the van isn't theirs either. They use contractors to shield themselves from liability and allow the worst companies to hire cheap foreign labor. They do the same thing in long haul trucking under the program Amazon Relay.

The person whose car got hit should not be contacting anyone but her automobile insurance. The reason you pay for car insurance is for them to deal with situations like this.

Had a similar incident happen to my car. Amazon’s third party would only pay so much. I filed a claim with my insurance company and they went after the third party insurance company and got full payment from them with no claim on my insurance record.

Amazon/gig economy scammed us. We thought oh, independent contractor, they can be their own boss etc. but they preyed on our emotions, only to off load all liabilities... payroll taxes, vehicle maintenance, vehicle insurance/health insurance and more. Huge net win for Amazon who is no longer on the hook, especially in cases like this.

The real scandal: Companies dodge all accountability and liability by hiding behind “third parties” like Amazon. If your name’s plastered on the truck, you damn well should be held fully responsible—no excuses!!!

This is stupid. They should have filed the claim with their own insurance company which would then initiate subrogation.
