Someone tell this idiot that the Epstein files were sealed by a judge pending Epstein's investigation and indictment in 2019 and then for Ghislaine Maxwell's prosecution and trial, which ended in 2022. They have been held by the FBI and Justice Department, which refused to release them, bringing us to the current moment.

🚨NEW: (not really) @StephanASmith doesn't understand the basic law🚨 Stephen A. Smith is missing the most important fact in the entire conversation. The White House does not “open” Epstein files. Presidents cannot unseal court-protected records. These documents are controlled by federal judges, not by Biden, not by Trump, not by any administration, and not by any political party. Most of the Epstein material remained sealed because of court orders going back years. The only reason these files are coming out now is because of a specific lawsuit, multiple rulings from Judge Preska, and a formal unsealing process that has been underway since before the convicted felon took office again. No president can walk into a courthouse and say, open the sealed evidence, that is not how the legal system works. And this is where the argument collapses completely. If Stephen A. thinks the Biden administration could have just snapped its fingers and opened the files, then he also has to explain why the convicted felon never did it during his entire first term, even though he had four years, his own DOJ, and a friendly Supreme Court. He did nothing. In fact, his own Attorney General, Bill Barr, kept major parts of the Epstein case sealed and allowed the system to keep hiding critical documents. If the convicted felon cared about transparency, he would have ordered the release in 2017, 2018, 2019, or 2020. He did not. Instead, he did everything he could to block disclosures. So no, this is not something Democrats “could have opened.” Courts open sealed records when victims request it, when lawsuits demand it, and when judges approve it. This timeline has nothing to do with Biden, and everything to do with the legal process finally catching up. The only thing that smells is people pretending presidents control sealed evidence when they know very well they do not.
