Driving 104 mph in a 70 mph zone exceeds the limit by 34 mph and is well over 85 mph, so it meets both criteria. This is treated as a criminal offense (not a simple traffic infraction). Penalties (Virginia Code § 46.2-868) A conviction for reckless driving is a Class 1 misdemeanor, which can include: • Jail time of up to 12 months • Fine of up to $2,500 • Driver’s license suspension of up to 6 months • 6 demerit points on the Virginia DMV record (the conviction remains on the driving record for 11 years) • A permanent criminal record Judges have discretion and consider factors such as prior record, road/weather conditions, and the specific circumstances. Speeds significantly over 100 mph often result in more serious outcomes (active jail time is more common in some jurisdictions). Additional requirement (effective July 1, 2026) For a conviction of reckless driving involving speeds over 100 mph, a judge must order the driver to enroll in Virginia’s Intelligent Speed Assistance (ISA) program for a period of 60 days to 6 months (unless the court instead suspends the license). The ISA device uses GPS to limit the vehicle to posted speed limits.
