So Judge Katwat Kigen’s recommendation that he can recuse himself during a presidential petition is not founded in law. Recusing himself during the presidential petition would seriously affect the quorum of the court, thus rendering it inoperative. This means that the Supreme Court would never have the jurisdiction to hear the petition. Now think about his proposal politically.
