In 2016, the then Conservative Prime Minister, David Cameron, commissioned the then backbench Labour MP, David Lammy to conduct a review and investigate racial bias in the criminal justice system of England and Wales. The report known as the Lammy Report was published in 2017. It's proven to be quite a significant report in many ways in shaping government policy, information collected by institutions in our CJS, and areas of focus. Ironically, one of the key findings of the report was that black people were disproportionately more likely to be negatively impacted in non-jury trials as they were in jury trials. Judges were overwhelmingly older, white, public school educated, middle class men. In his view, jury trials provided greater protection against the structural issues he found in his own report. Fast forward to 2026. The same David Lammy is now a Rt. Hon. Justice Secretary, proposing to create MORE non-jury trials.
