Fremantle will try argue 'severe' impact down to 'high', which would see this ban downgraded from three matches to two matches.

Fremantle is wishing to rely on evidence from a plastic and reconstructive surgeon as part of its case.

We have spent nearly the last 10 minutes debating whether a plastic surgeon's evidence would be of 'significant probative value' in determining whether Patrick Voss will miss three matches or two matches. This is everything wrong with the AFL Tribunal.

After 15 minutes, the AFL Tribunal has determined the plastic surgeon's evidence is not of 'significant probative value'

FYI we haven't even begun arguing the case yet, this is all about what is and isn't allowed to be relied upon as evidence.

AFL's reasons why this is severe impact: 1 - Injury suffered 2 - Force of contact clear on the footage 3 - Voss did nothing to reduce impact 4 - Vlastuin's reaction 5 - Remonstration from other players 6 - There was significant risk of more serious injury

Tim Hammond (Dockers): "The expected number of missed days training (for Vlastuin) is 0... it's at best mild."

Jeff Gleeson (Chair) says the Tribunal will generally put "little if any weight" into how other players react to incidents.

The Tribunal is now deliberating.

The Dockers response to the six points: 1. Vlastuin not missing any training nor matches 2. “Common sense analysis” required to determine this isn’t severe force 3. "Unintended consequences of a height differential” on an attempted tackle; 4 and 5. Gleeson interrupted before the Dockers could respond to point four and five saying they never put any real weight on player reaction or remonstration 6. Evidence wasn’t there to suggest this level of impact was likely to cause concussion. Dockers noted 24 comparable incidents graded as severe impact, saying in 23 of those cases the victim player didn’t play the following week.

Patrick Voss' ban has been upheld. He'll miss the next three matches.

We find that the impact here was severe. The guidelines provide that when considering impact, consideration will be given to the extent of force. It is apparent from the video footage that the force here was very considerable indeed. Players met at speed and Voss swung his arm at speed. Contact was not checked in any way. It did not glance off any part of Vlastuin's body. His arm was fully extended and quite rigid. Vlastuin's legs appeared to give way underneath him and he collapsed to the ground. It took him approximately 20 seconds to get back to his feet. The extent and nature of the force of impact, and the fact that the full force of the impact struck Vlastuin's face leads us to find the potential for more serious injury was real. Fremantle submitted there was no evidence that would permit us to find that there was potential for injury. We disagree. The video evidence shows quite clearly that this was a forceful blow to the head, and one that experience and common sense indicates could readily have resulted in a concussion. The example video of Jack Crisp (and Kallan Dawson) is not sufficiently comparable. The arm there was not swung with the same force, and we are informed that Crisp did not suffer any injury. He also appeared less affected by the impact. We are satisfied that the impact of this strike was severe.
