Agency Gumbo represents the kind of opposition Member of Parliament that every democracy needs. We are all Zimbabweans, but people hold different political views, ideologies and visions for the country. Those citizens deserve representatives who can clearly, intelligently and fearlessly articulate their positions in Parliament. His contribution during yesterday’s debate on the controversial Constitutional Amendment Bill No. 3 demonstrated exactly what an effective opposition MP should do, scrutinise legislation, challenge those in power, and give voice to the concerns of the citizens he represents. Agency Gumbo showed the importance of having opposition legislators who are informed, articulate and prepared to defend the constitutional principles and democratic values they believe in. I note Prime Minister Andrew Holness’s remarks in a TV interview this morning. Neither he nor his Party has made those proposals as part of the process of constitutional reform. His proposals are therefore not in the report of the Constitutional Reform Committee, and will not be in the new Constitution coming out of that process. Furthermore, Mr. Holness’s proposals are not in the existing Constitution, and would violate the existing Constitution. This is in keeping with his and his Government’s unfortunate history of past violations of the Constitution of Jamaica. It seems that the Prime Minister wants to make up a rule which is not part of the Constitution or laws of Jamaica, to suit his Party’s political fortune at a time when it is waning. He has no power and no authority to do that. He needs to tell the country why his statutory declarations to the Integrity Commission cannot be certified. I am compliant with the Constitution and laws of Jamaica, and I undertake to the People of Jamaica that I will continue to be so.

I strongly condemn the violent attack at Witima ACK Church in Othaya, where former Deputy President Rigathi Gachagua and his team, together with unarmed leaders and civilians, are trapped inside a place of worship as live bullets and tear gas are deployed and vehicles torched outside. This is a grave and unacceptable violation of the Constitution and the rule of law. A church is a sacred and protected space. The use of force against unarmed citizens in such circumstances is unlawful and indefensible. I hold the Inspector General of Police and all those responsible fully accountable for the safety of Rigathi Gachagua, his team, and all civilians inside the church. No political ambition or rivalry can ever justify terrorising citizens or attacking a place of worship. Kenya must remain a constitutional democracy governed by law, not violence, fear, or impunity.

That’s the point I’m making. We must never say in our Constitution of Zimbabwe that if a sitting President dies or resigns, we will wait to hear what the political party of that President is saying. No. That is not the best way of running a country. Political parties remain the preserve of those people who are in those political parties. But the country is run on the basis of either an election by the people—direct election—or you have Parliament as an institution sitting as an electoral college. Where parties have influence, they must do the influence within Parliament, but never to allow the political party to sit there to say I’m giving you this President, and so forth. That’s the point I’m making. And on that point, I’m making it right across the world; that’s what they do.” - Professor Madhuku, addressing a “Heal Zimbabwe Trust” public meeting in Harare on 22 February 2020. The proper solution is straightforward: Parliament—the institution chosen by the people—should act as the electoral college. This principle is not abstract. Worldwide, presidential by-elections to fill mid-term vacancies are extremely rare. Most stable presidential systems instead use automatic succession by a deputy or, increasingly, allow the legislature to elect a successor who serves out the remainder of the term. These arrangements place national continuity and stability above partisan interests. Clause 3 of the Bill follows exactly this proven path. By giving Parliament the clear duty to elect the President—whether at the start of a new term or in an unforeseen vacancy—Zimbabwe will secure stronger democratic stability, and keep the highest office firmly within the people’s constitutional framework rather than the private control of any single party. In short, Clause 3 is a mature, practical and principled reform that directly honours Professor Madhuku’s wise 2020 counsel. As such, it deserves the full support of every well-meaning Zimbabwean who values good governance, democratic constitutionalism, institutional integrity and the long-term strength of the country’s democracy in the national interest!

We’re confronted with a jarring reality. A Judge’s residence in Lutyen's Delhi had burnt notes and cash. There is no FIR till date. We have in the country rule of law, criminal justice system. There can be no occasion whatsoever to delay even for a moment because that is ordainment of law. The rule of law is the very foundation of society. #Democracy has to be defined primarily by three aspects: expression, dialogue and accountability. Therefore, if we have to really nurture democracy, it is inescapable that we hold every institution and every individual accountable and in accordance with law. The surest way to degenerate an individual or bring down an institution is to keep it away from probe and scrutiny, which means that the individual becomes law unto oneself. #Constitution
