I maintain that Kenya’s next General Election must be held in August 2026, not 2027. Article 136(2)(a) of the Constitution is explicit: a presidential election shall be held on the second Tuesday in August in every fifth year. The Constitution does not say after five years. It says in the fifth year. A term that runs beyond August 2026 spills into a sixth year, which the Constitution does not permit. Constitutional timelines are not elastic, and political convenience cannot override clear constitutional text. If we respect the supremacy of the Constitution, then elections must be held in August 2026.

“Our democracy” is simply Rousseau’s General Will. It declares one side the rightful owner of the system, so an election loss becomes an attack on democracy itself instead of democracy working. Rousseau said the nation has a single General Will, the true interest of the people, separate from what individuals actually vote for. Anyone who rejects it can be forced to be free because their dissent only proves they misunderstand their real interest. Replace “General Will” with “our democracy” and the logic is the same. The other side is not a rival to persuade but a threat to something you already embody.

It is vitally important in a free society that people are free to express themselves. We must distinguish between acts that criticise or challenge an ideology, religion or belief system, and acts that target people because of who they are. At a recent event, a guest asked whether we believe there should be any limits on free speech, citing our defence of those who have burned copies of the Koran. People must be free to express themselves, and sometimes symbolic acts are the most powerful form of expression. Context matters.
