REALITY CHECK 5: DIGONG CANNOT BE EXTRADITED BACK Former SC Justice Antonio Carpio clarifies some of the DDS' confusion. Was there a violation of the Rome Statute when Digong was arrested by the ICC without going through a Philippine court? No. Article 59 of the Rome Statute does require... that Digong's arrest should have gone through a domestic court if the Philippines was still a State Party. Since our withdrawal from the ICC, this no longer applies. This alleged misstep in Digong's apprehension no longer exists because of his own doing. Was Digong illegally surrendered to the Interpol? No. Section 17 of RA 9851 states that, "in the interest of justice, the relevant Philippine authorities may dispense with the investigation or prosecution of a crime punishable under this Act if another court or international tribunal is already conducting the investigation or undertaking the prosecution of such crime. Instead, the authorities may surrender or extradite suspected or accused persons in the Philippines to the appropriate international court, if any, or to another State pursuant to the applicable extradition laws and treaties." Can the Supreme Court of the Philippines compel the ICC to return Digong? No. Even if Digong was served an ICC warrant without a counterpart warrant from a Philippine court, the Supreme Court does not have jurisdiction over the ICC nor the Netherlands to compel them to surrender Digong. Can Digong's legal team argue that he was kidnapped and unlawfully surrendered to the ICC? Yes. But it won't bring back Digong to the Philippines. The ICC follows a doctrine or rule that disregards the manner by which a suspect is surrendered to their jurisdiction even if this be by kidnapping. It doesn't matter to the ICC since they didn't commit the abduction. They merely received a suspect surrendered by a State. The sound of DDS anguish continues to grow louder. Sharing my live broadcast media interview with Russia Today (RT) late last night. The interview focused on former President Rodrigo Duterte and the unfolding events in the Philippines, which have garnered significant media attention both domestically and internationally. Duterte has been arrested and transferred to the International Criminal Court (ICC) in The Hague to face charges of crimes against humanity related to the anti-drug campaign during his presidency from 2016 to 2022. Duterte was apprehended in Manila on March 11, 2025, upon returning from Hong Kong from a family vacation. His arrest followed a 12-hour standoff at the Manila Villamor air base. He was subsequently transported to The Hague, arriving at Rotterdam Airport on March 12, 2025. Note that the ICC has no jurisdiction over the conduct of the Philippines after its withdrawal from the Rome Statute. Under Article 127, paragraph 1, of the Rome Statute, a State may withdraw from the Statute by notification in writing to the Secretary-General of the United Nations, which will take effect one year after the date of notification. The Philippines officially initiated the process of withdrawal on March 17, 2018, and the withdrawal took effect on March 17, 2019, making the withdrawal legal and effective. According to Article 127, paragraph 2, of the Rome Statute, even if a State withdraws from the Statute, its withdrawal does not exempt it from legal obligations undertaken during the State's time as a State party or from investigative proceedings that have been initiated. The United States is not a state party to the Rome Statute, which founded the International Criminal Court (ICC) in 2002. The sole reason the Trump regime is going after the ICC is to try and protect Netanyahu. The ICC has issued an arrest warrant for Netanyahu, allegeding that he is responsible for the war crimes of starvation as a method of warfare and of intentionally directing an attack against the civilian population; and the crimes against humanity of murder, persecution, and other inhumane acts from at least 8 October 2023 until at least 20 May 2024. American citizens have nothing to fear from the ICC...

Congressman Zia Alonto Adiong pointed out that the Duterte bloc and the majority of Senators only respect the Supreme Court ruling only when it is convenient. When it favors their principal — Sara Zimmerman Duterte. The House of Representatives are merely exhausting all legal remedies to protect the power granted to them by the 1987 Constitution. The Supreme Court ruled in Pangilinan et al vs. Cayetano et. all that the ICC has jurisdiction in supposed crimes committed before the Philippines from the ICC (G.R. No. 238875). Transparency is the only way to disprove Trillanes, but this seems impossible now that Duterte is detained at the ICC. However, don’t forget the co-owner of this bank account: Sara Duterte. With her trial nearing, the impeachment court can compel the AMLC to open its details.

Karim Khan, the British chief prosecutor of the International Criminal Court was warned in May that if arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former Defence Minister Yoav Gallant were not withdrawn, he and the ICC would be “destroyed", Middle East Eye can exclusively reveal. The warning was delivered to Khan by Nicholas Kaufman, a British-Israeli defence lawyer at the court who told Khan he had spoken to Netanyahu’s legal advisor and, according to a note of the meeting lodged on file at the ICC and seen by Middle East Eye, was “authorised” to make him a proposal that would allow Khan to “climb down the tree”.

A LOOK AT THE ICC DETENTION CENTRE The ICC Detention Centre is located within a Dutch prison complex in Scheveningen - on the outskirts of The Hague in Netherlands. Detained persons have access to fresh air, recreational time and sports activities. They have access to library books, news and television. They can also cook for themselves. The detained person can also access computer facilities. They have one computer in their cell, which is linked to a specific computer at the Court, and only their defense will have access. The defense can upload case-related material which the detained person can access and make comments on. The detained person can be visited by a consular or diplomatic representative of his/her country, and is entitled to privileged communication with them. He can also be visited by a minister or spiritual advisor, or by the International Committee of the Red Cross. Detained persons are presumed innocent until proven guilty.
