The attack hasn’t been publicly acknowledged by the White House, and officials say it’s unclear what will happen to the survivors now in U.S. custody. Legally, the U.S. can’t just hold them indefinitely at sea. International law, including the Geneva Conventions and maritime law. These require that detainees be given a clear legal status: 1) either turned over to law enforcement and charged under the Maritime Drug Law Enforcement Act,or 2) repatriated to their home country if no charges are filed.
