It’s innovative and within the rules, what F1 is all about. Just one of those things where if your team had done it you’d be fine with it but they didn’t so it’s “illegal”

I love innovation in F1. That's one of the reasons I've been following the sport since the 90s. However, the regulations and tests must be the same for everyone. Last year the FIA banned Aston Martin's flexi front wing after 8 races. In 2021 after repeated complaints from Mercedes, the FIA banned Red Bull's flexi wings in Baku, even though the same wings had been approved by the FIA previously.
