@SECGov Existing authority can keep the work moving. It cannot replace durable market rules. If crypto policy depends on who holds the chair, the industry has guidance today and uncertainty after the next election. That is motion, not clarity.

Lindman is basically saying the SEC doesn’t need permission from Congress to rebuild the system. 🏛️ They’ve already used this 'existing authority' to scrap Gensler era rules, push a new crypto custody framework, and open the floodgates for tokenized stocks. The agency is rewriting the rules of the game on its own terms.

@SECGov Existing authority is the whole problem. Anything the SEC can do without Congress, the next SEC can undo without Congress. Builders wanted a floor written in statute, not a chairman's good mood.

Acting under existing authority is faster, but it's also less durable: guidance, exemptions and no-action positions can be rewritten by a later commission, while a statute can't. That's the real tradeoff behind "we don't need CLARITY to move forward" — speed now versus a rulebook that survives the next change of leadership.

@SECGov Existing authority covers SEC disclosure, custody and fraud cases. It does not decide which assets are commodities, or which agency registers an exchange. CLARITY was written to settle that split, so dropping the bill slows the boundary even if the Task Force keeps moving.
