It gets even crazier man. They've literally locked up people for selling "machine guns" that were a PART of a machine gun DRAWN on a credit card sized piece of metal as a novelty. Keep in mind it wasn't a functional part of anything, but literally a harmless drawing.

The ATF is an executive agency. Only the Legislature is empowered to enact laws. Anything the ATF (or any other agency) tries to push as a law (regardless of what they call it) is unconstitutional amd should be summarily disregarded.
