If they don't have a gate covering the entrance, it's considered public access. Same with the sidewalk that walks up to your front door. If it's attached to your driveway, which is attached to the road.

It's not my logic. It's the Supreme Courts and it's not a public highway. It's "public access" Which is a legal term. It doesn't mean what you think it does. But it does allow the public to come up upon your "curtilage" on your property.

It’s called the ‘open fields exception’ to the 4th Amendment. Police can enter property outside a residence curtilage, but they have to have RAS of a violation of some sort. Put up a gate and keep it locked. They can’t break the lock.

Put a sign up stating Private Property this includes law enforcement is not allowed up there without previous written permission by the owner. Trespassers will be shot without warning.

When subdivisions are created, they usually hand over the streets to "public right of way" Once this occurs, law enforcement can patrol those subdivisions. This documents are usually found at a county, when the homes were created. Otherwise they would of built a gate.

Private property access points (driveways, pathways to a front door, paved roadways) should be barred, gated, fenced (etc.) and/or posted against trespassing. Otherwise, they imply consent to enter. Something to think about.
