County prosecutor doesn’t have authority on private property

Incredible how every single issue somehow loops back to the same three talking points...... Must be exhausting being this consistent!!

Why next time. Do it now. Absolutely make a big deal out of it.

Yes, drop everything and turn a 30 sec driveway chat into a full blown constitutional crisis. The history books are waiting tbh...

Yes, actually. Its private property. I know you commies hate that.

This absolutely 100% NOT allowed. Those cops should have been taken to task on this. I would have a legal complaint….and next….had a gate put up

Kaithrine miller 的头像
Kaithrine miller1 个月前

Absolutely, those officers should be tried for the high crime of… existing near a house. Meanwhile the rest of us are over here dealing with actual problems!!

had a similar problem years ago, after contacting state/district rep (who presumably contacted state attorney general over it), the problem went away pretty quickly...

If they don't have a gate covering the entrance, it's considered public access. Same with the sidewalk that walks up to your front door. If it's attached to your driveway, which is attached to the road.

Kaithrine miller 的头像
Kaithrine miller1 个月前

So by your logic, every driveway in America is basically a public highway and my porch is a community gathering spot. Cool, I’ll start charging parking fees??? Right??

Istanu 🇺🇸 ✝️ 的头像
Istanu 🇺🇸 ✝️1 个月前

It's not my logic. It's the Supreme Courts and it's not a public highway. It's "public access" Which is a legal term. It doesn't mean what you think it does. But it does allow the public to come up upon your "curtilage" on your property.

“There’s people in the neighborhood who want us up here.” “The county prosecutor said we’re good to go.” I’m willing to bet this is a long standing dispute and that one of their neighbors specifically granted them blanket permission, which the prosecutor documented.

Kaithrine miller 的头像
Kaithrine miller1 个月前

Yesss, there’s people in the neighborhood who want us up here’ is the new ‘the dog ate my homework.’ Next they’ll claim the county surveyor personally invited them for tea lol

SagebrushBirdhunter 的头像
SagebrushBirdhunter1 个月前

No, I think they will claim one of his neighbors did. Because that’s what they said. And the county prosecutor was clearly aware. So you can assume lies and conspiracy if you want; my money is on the explanation they actually gave.

Level 4 plates and a letter… got it. I’ll add that to my list of totally normal things to yell at the process server next time!!

Retards: If your road or sidewalk is not gated, and attaches to a public thoroughfare, it's regarded as a "tacit invitation to visitors", to Quote Justice Scalia, "That's why a girl scout or trick r treater knocking on your door is not trespassing". SCOTUS, Florida v. Jardines

It’s called the ‘open fields exception’ to the 4th Amendment. Police can enter property outside a residence curtilage, but they have to have RAS of a violation of some sort. Put up a gate and keep it locked. They can’t break the lock.

always makes me wonder, how far these type of cops will go before someone upholds their rights, and uses force. Trespasser is still a trespasser even if it wears a uniform

Every US citizen has an obligation to know their rights and hold those who trample on our rights accountable. Never relent, and never bend the knee to Authoritarianism!

They are armed interlopers on private property, dressed up as cops. An armed response would be justified

Put a sign up stating Private Property this includes law enforcement is not allowed up there without previous written permission by the owner. Trespassers will be shot without warning.

MariusReform 的头像
MariusReform1 个月前

Saying “this is private property” should’ve been the end of the interaction. It sucks but gates and big signs are an easy fix. To the boot connoisseurs talking about “public access”, depending on the size of the property & proximity to the home “curtilage” can apply here.

Couple of armed goons on private property with no proper legal authority or paperwork to be there. They lucky they aint shot. Its not hard to get a fake police car and tactical gear.

When subdivisions are created, they usually hand over the streets to "public right of way" Once this occurs, law enforcement can patrol those subdivisions. This documents are usually found at a county, when the homes were created. Otherwise they would of built a gate.

Private property access points (driveways, pathways to a front door, paved roadways) should be barred, gated, fenced (etc.) and/or posted against trespassing. Otherwise, they imply consent to enter. Something to think about.

That's called corrupt cops, i would file a lawsuit against both cops, the prosecutor and also have their immunity stripped.. If my PTSD kicked in I might set some flash bangs, or spike strips on my land where if they run over they won't be leaving unless their towed

Guarantee the county prosecutor did not tell them they can go on private property anytime they want. This is cops being stupid and trying to bluff their way thru a bad situation.. and it blowing up in their face.
