It's illegal in Texas. Open container laws were put in place because of so many DWIs where people would hand the alcohol to someone else in the car, then try to play it off. All of this "don't touch me" and refusing to cooperate has gotten completely out of control.

It's not clear why the officer felt he had the right to pull the passenger out of the car. In order to do so, you must articulate clearly some statute that was violated, or suspected of being violated. What was it? It's missing. Based on that, the officer's actions are improper.
