Point of Correction – The President of the United States is not elected by the entire American people but by the majority. This means that some Americans did not vote for the President. In a democracy, the Judiciary serves as a crucial check on the Executive to ensure that the rights of the minority are protected. Without the Judiciary, democracy cannot function. Similarly, without Legislators, democracy does not exist. The Executive branch is responsible for enforcing laws created by the Legislature and interpreted by the Judiciary. No single branch has the authority to act unilaterally outside its constitutional limits. That is why judges undergo screening by Senators, who represent the interests of their constituencies. The framers of the Constitution designed a system of three coequal branches of government to prevent the tyranny of the majority and ensure that decisions made by a President—elected by a majority—still consider the rights of the minority. Checks and balances are the foundation of a democratic society. They are not just important but essential to preserving democratic values.
