THE CONSTITUTION CANNOT WAIT FOR THE NEXT ELECTION! DELETED VOTERS, DELAYED JUSTICE—A REPUBLIC ON TRIAL. In West Bengal's SIR appeals, approximately 93% of decided appeals have resulted in inclusion. 93% of decided appeals have resulted in inclusion, what % of deleted voters have appealed will not be stated as it is less than 2% which means almost 98% omission is correct. Misuse of statistics.

My lords have time to dictate but they don’t check their plate. Lakhs of cases are pending and how many people are suffering. Nobody knows the pain. Attending the court hearing for years is the biggest punishment to those go to court at the ground level

SIR is about cleaning the voter list - 13% entries deleted were deceased / domicile shifted / duplicate. ECI is doing its job. Those opposing it are mostly political leaders who see it as affecting their vote bank, along with some student groups led by Dipke.

WHEN LAWYERS ARE DRAGGED, THE CONSTITUTION IS ON TRIAL The Constitution does not confer fundamental rights as an act of governmental generosity. It guarantees them as limitations upon governmental power. When Senior Consel informed the Supreme Court that advocates had allegedly been dragged through the streets, detained in buses, and that armed miscreants had attacked citizens while the police stood by, he raised a question far greater than the dignity of the Bar. He raised the question of whether the Rule of Law still governs those entrusted with enforcing it. A policeman’s uniform is not a licence to violate liberty. Nor can Section 163 BNSS become a charter for executive absolutism. The right to peaceful protest is not extinguished because its exercise embarrasses the Government. Public order is a constitutional necessity; it cannot become a convenient euphemism for suppressing dissent. Chief Justice Surya Kant rightly emphasised the right of advocates to participate peacefully at designated locations. But the constitutional duty does not end with recognising a right. A right without an effective remedy is a constitutional promise reduced to a political platitude. The Supreme Court is not merely the highest court of the land. It is the final sentinel of those liberties which the Executive may find inconvenient and the citizen cannot afford to lose. When the State demands restraint from citizens, the Constitution demands restraint from the State. And when those who plead for justice are themselves allegedly subjected to coercion, judicial silence risks becoming the most eloquent encouragement to arbitrary power. The majesty of the Supreme Court lies not in the height of its dome, but in the courage of its judgments. — NK Goswami Advocate, Supreme Court of India #SupremeCourt #CJISuryaKant #GopalSankaranarayanan #SCBA #RuleOfLaw #ConstitutionOfIndia #CivilLiberties #DelhiProtests #NKGoswami

When a former Supreme Court judge says the right to vote is “at great peril,” it is not an opposition slogan. It is a red flag from inside the institution. Justice Rohinton Nariman, Rajkot, 27 September: In the Bengal SIR, he said, about 90 lakh voters were knocked off the rolls, and the Court did not stay it. Of those excluded, 22 lakh filed appeals. The rest, he said, were largely people without the means or the access to fight. Of roughly 1 lakh appeals decided, 93% went in the voter’s favour. EC’s own affidavit puts deleted names after adjudication at 27.16 lakh, appeals against exclusion at 22.21 lakh, and about 93% of decided appeals ending in inclusion. That is not a clean-up. That is a mass deletion that the appeal process keeps reversing. He also flagged the Indian Express report: the two Election Commissioners objected 14 times, and still did not use Section 18 to outvote the CEC. All three are appointees of this government. Then came the “patch-up.” Nariman’s ask is simple. The Supreme Court should step in. Appointments cannot stay in the hands of the government of the day. Restore the Anoop Baranwal panel: Prime Minister, Leader of Opposition, and the Chief Justice. You cannot have an Election Commission that functions, or malfunctions, like this. The heart of the Constitution is the vote. It is being edited and quite often mercilessly DELETED. #RightToVote #ElectionCommission #SIR #RohintonNariman #SaveDemocracy CNN BBC The Wall Street Journal Al Jazeera English

THE CONSTITUTION PROTECTS PROTEST — NOT A PRIVILEGE TO DISOBEY THE LAW. JANTAR MANTAR, THE COCKROACH JANTA PARTY AND THE LIMITS OF CONSTITUTIONAL DISSENT The Delhi High Court's questions to CJP leaders Saurav Das and Ashutosh Ranka go to the heart of constitutional democracy. If you have executed a peace bond, what legal justification permits you to disregard its conditions? If Parliament has provided a statutory appellate remedy under Section 414 BNSS for specified security and surety orders, why bypass that remedy without establishing exceptional grounds? And if the Government has designated alternative protest sites, why insist upon entering a restricted location rather than pursuing lawful remedies? THE RIGHT TO PROTEST IS NOT THE RIGHT TO CHOOSE WHICH LAWS ONE WILL OBEY. But the Constitution places an equally serious duty upon the State. A PEACE BOND CANNOT BECOME A BOND OF POLITICAL SILENCE. No administration may use preventive powers to punish citizens merely for expressing dissent. Every restriction must satisfy the law; every detention must withstand judicial scrutiny. THE CONSTITUTION RECOGNISES NEITHER AN UNACCOUNTABLE GOVERNMENT NOR AN UNACCOUNTABLE PROTESTER. Political passion cannot replace legal discipline. State authority cannot replace constitutional restraint. THE RULE OF LAW IS NOT A WEAPON TO BE USED AGAINST ONE SIDE. IT IS THE STANDARD BY WHICH BOTH SIDES MUST BE JUDGED. — NK Goswami Advocate, Supreme Court of India #DelhiHighCourt #JantarMantar #CockroachJantaParty #RightToProtest #SupremeCourt #BNSS #SauravDas #AshutoshRanka #DelhiPolice #Article226 #RuleOfLaw #ConstitutionOfIndia #NKGoswami Cockroaches of India Cockroach Janta Party - CJP Cockroach Janta Party Rahul Gandhi Prashant Bhushan Mahesh Jethmalani Kapil Sibal Akhilesh Yadav Mohan Bhagwat RSS Donald J. #WATCH | Delhi: On SC judge Justice Ujjal Bhuyan's views on citizens' right to vote, Former Judge at the Uttarakhand High Court, Lokpal Singh, says, "As far as intensive revision of votes is concerned, it is a normal process. The Election Commission of India is engaged in this process throughout the year for adding or deleting the names of the voters... intensive revisions should be done. So far as gross deletion of names is concerned, it is the ECI that can see it better. It's always easy to say that thousands of votes have been deleted. But when the people and the population of the particular states... Bihar and West Bengal, both the states are adjoining Bangladesh. Infiltration cannot be denied. So many fake votes are there. If the ECI, after verification, has deleted the names of so many persons, and those persons who have not come—for them, so many institutions are coming forward saying, 'Yes, a bulk of voters have been deleted in Bihar or West Bengal.' I feel that no one can deny the infiltration from West Bengal... So, a change of govt is one part. I feel that no one should blame the Central govt, saying that due to their intervention in West Bengal, the regime has changed..." On Justice Nariman's remarks, he says, "Justice Nariman is a jurist of this country. I have a great respect for Justice Nariman. But so far as the statement of the election of West Bengal is concerned, I do not agree with Justice Nariman. 90 lakhs were deleted... now you have been watching the news that after the elections, so many persons traveled from West Bengal to Bangladesh. Can anyone question this? Can anyone find out from where they came and why they are returning to Bangladesh? If they were citizens of India, they should not have traveled from West Bengal to Bangladesh, so I do not have any agreement with Justice Nariman on this point..."
