Nobody can convince me that a police officer should have to take that. In 1942 the Supreme Court ruled that “fighting words” are not protected free speech. With Chaplinsky versus New Hampshire, they said fighting words aren’t protected speech if they’re likely to spark immediate violence, like personal insults that incite a fight. It’s been narrowed since, focusing on stuff that’s personally targeted, not just offensive. They haven’t overturned it, but lower courts barely use it anymore.

He should have just arrested him on suspicion of intoxicated in public. Once they run the blood tests, they'll find all the drugs.
