Nope. Just always try to be that way. Has served me well in 35 years of business ownership. Too many people just go for the throat, lawyers etc. More people just need to work together.

As a dealer if tou sold it with frame damage if you knew it or not that’s not a fight I would want to fight in court. Dealers don’t win that case. And yes a salvaged title car customer will get every penny back and dealer will have to see who washed the title

Personally, I would pay the buyer $0.00 for this transaction. If the seller had the carfax, and based the As-Is sale on that information, and did not have any knowledge of unreported damage, then customer gets ZERO, even if buyer’s brother works at a TV station. I’d turn it on the buyer and go public with the strong-arm tactics and give the brother a chance to respond on camera….that 💩 will stop right there.

In Switzerland the buyer would have been in the right and the purchase contract would have been void after the discovery of the hidden damage or defect. The seller could even be charged with fraud, if he knew about the hidden damage without disclosing it.

The car was sold as-is and the dealership did not misrepresent the car. The dealership does not have an obligation to start pulling off body panels to search for frame damage before selling a car. For all we know, the customer caused this damage.

A basic inspection would have revealed frame damage before he bought the car from the dealer. Carfax only shows reported accidents,if there was no report, there would be no carfax. I wouldn’t be surprised if Tesla didn’t report damage on a lease return just to maximize the value

Every used car dealer is required by law to inform a customer of previous damage but a lot of times they are not aware of it! This is why they make the buyer sign an agreement to absolve the dealer from being held accountable for damage that they were never aware of!! Every car dealer uses this document when they sell a used car and they are iron clad and the buyer legally has no claims for the dealer they have bought the car from, especially when the car has been involved in an accident after the purchase date. No matter if a repair facility says that it was pre-existing damage. The buyer could have taken the car to his brother's employer to get bumper repaired at a discount price without ever doing a full inspection on the car. Even a brand new car can have damage repaired before the selling dealer gets it in their possession, most times the manufacturer will actually send the car to a different dealer for repairs and the manufacturer doesn't have to disclose it because it was never delivered to the selling dealer and there is essentially no records of the repair so the selling dealer is never privy of that information!!!!

The buyers issue, and only recourse, is with Carfax.

As a professional dealer, it is his responsibility to know what he is selling. The only question is if the customer’s own accident was severe enough to have caused the damage… if not, dealer is losing in court 9/10 times.

Mostly w/ customer on this one. Dealer absolutely would have known details of auction. They also would have inspected it. Consumer took the word of the dealer aka professionals who MOST LIKELY said they do a xx point inspection and it's 'good to go'.

Hiding frame damage is sleazy as fuck.
