If you look at how they talk about Black QBs vs other QBs today, they still operate under the same assumption

It's not an assumption. What you think is condemning them is actually an out they created. This was unfortunately done with intent to freeze out a predominantly black league out of being able to collect on the CTE settlement & more. They weren't operating on an assumption.
