Having worked at the mall and department stores in high school, long ago, there was still tons of shoplifting and theft, but it was all attempted to be hidden. And people caught were arrested 100% of the time. Sat in security office until police arrived. This is different.

Is it illegal for an employee to grab store merchandise from a shoplifter? 👨‍⚖️LAWYER’S TAKE 👇 In this clip, it appears a store employee is trying to stop a shoplifter from stealing store merchandise. Is this ok? The California legislature is currently considering this question and may pass a law on this in the near future. First off, most US states have what's called "Shopkeepers Privilege" laws. These laws hold, generally, that store owners have the legal right to detain a suspected shoplifter on their premises for a reasonable period of time, so long as the shopkeeper has probable cause to believe that the person has stolen or is attempting to steal merchandise. Proper procedure for a store employee wishing to stop a shoplifter is: Observation: The employee should observe the suspected individual from the time they enter the store until the alleged act of theft. Concealment: The suspect must be observed concealing merchandise or somehow making it obvious that they intend to steal. Surveillance: The suspect must be under continuous observation to ensure that they do not discard the merchandise. Apprehension past the last point of sale: The suspect must be approached and detained after passing the last point of sale without paying for the concealed item(s). Reasonable time and manner: The detention must be conducted in a reasonable time and manner. It should not be physically abusive or unnecessarily long. This video clip only shows the alleged employee "detaining" and obtaining the stolen merchandise. Because he appears to be careful not to really touch the suspect, and not use too much force, his conduct would be consistent with the Shopkeepers Privilege. Therefore, he and other employees may legally detain and take back merchandise from shoplifters. However, be aware of the fact that many employers have specific policies and rules against EVER detaining or in any way touching a shoplifter. Follow those rules if you are an employee or risk losing your job. Additionally, be aware of the fact that California proposed law SB 553, which bars businesses from requiring workers to intervene in such situations. In California, it may soon be illegal to stop shoplifters.

Revolving doors are a very good deterrent against shoplifing, maybe stores should consider installing them where shopping carts aren’t needed to carry heavy items out to the car.
