Mark Kelly isn’t flinching: “We said something simple: follow the law. And Donald Trump says kill them. He’s trying to silence us. He wants me to shut up. He picked the wrong guy, that ain’t happening.” A Navy captain. A combat pilot. An astronaut. Trump tried to bully him and Kelly just fired back with the force of someone who’s already survived worse. This is what standing up to a lawless president looks like.

Democratic Sen. Mark Kelly on Monday said he would not be silenced by President Donald Trump and Secretary of Defense Pete Hegseth after the Department of Defense announced last week that it would be launching a "thorough review" of the Arizona senator following the recently released video in which Kelly and other Democratic lawmakers called on U.S. troops to refuse illegal orders. "Trying to silence me in proposing to court martial me, in threatening to kill me for fighting back when our democracy demands that we must fight back. President Trump has crossed the line. And this time, it's not going to work," Kelly said. The Pentagon announced the investigation last week after President Donald Trump accused Kelly and the five other Democratic lawmakers in the video of sedition “punishable by death." Some legal experts are raising questions about the Pentagon’s investigation of Kelly, saying the Pentagon is misreading military law to go after Kelly as a retired Navy fighter pilot. Others say Kelly can’t be prosecuted as a member of Congress.

A federal judge on Thursday blocked the Pentagon from downgrading the military retirement rank and pay of Sen. Mark Kelly (D-AZ), finding that the government had "trampled on Senator Kelly's First Amendment freedoms." A retired Navy captain, Kelly drew the Trump administration's ire after he and five other Democratic lawmakers posted a video urging members of the military to "refuse illegal orders." Defense Secretary Pete Hegseth wrote on social media that the ruling would be "immediately appealed." Despite the legal victory, Kelly tells CBS News' Nikole Killion he is still concerned that the Trump administration could indict him and the other lawmakers as soon as tomorrow: "I wouldn't put anything past them." While a grand jury declined to bring charges against the six lawmakers earlier this week, there is still a chance the Department of Justice could try to charge them again with a different group of jurors.

Senator Mark Kelly: “Today, a federal court made clear that Pete Hegseth violated the Constitution when he tried to punish me for something I said. But this case was never just about me. This administration was sending a message to millions of retired veterans that they, too, can be censured or demoted just for speaking out”

🚨 BREAKING: Disgraced Sen. Mark Kelly Speaks After DC Court of Appeals Hears Oral Arguments in His Pentagon Legal Battle. Kelly is in hot water for appearing in a video urging U.S. military service members to disobey direct orders they deem “illegal” — actions many see as undermining the chain of command. The Pentagon under Sec. Pete Hegseth moved to censure him and review his retirement rank/pension. A lower court blocked it, and now the D.C. Circuit just heard arguments on appeal. Kelly is spinning it as a free speech victory. Many veterans and patriots call it reckless and dangerous.

Reporter: We've just learned that Democratic Senator Mark Kelly is suing Pete Hegseth. Mark Kelly is challenging an agency action under the Administrative Procedure Act, basically saying that Hegseth's decision to initiate a process that could demote him in terms of his ranking or deprive him of his pension is an arbitrary and capricious decision.

He’s melting down...again. Senator Mark Kelly blasts Secretary Hegseth’s censure of him as “BULLSH*T” in an unhinged rant to media. This comes after Hegseth initiated proceedings that could strip Kelly of his retired military rank and cut his pension. This left Kelly RATTLED. KELLY: “Let me make it perfectly clear.” “This letter or anything that Pete Hegseth says or does to me, is in no way going to affect the way I do my job and represent my constituents in the United States Senate.” “Ain’t happening!” Then came the profanity-laced outburst: “So, you know his option, you know, right now, is he can continue with this kind of BULLSH*T, or he can go take a hike!” “That’s his options, and if I have an opportunity to, you know, tell him that tomorrow maybe I will.”

Senator Mark Kelly (D-AZ) went on NBC and told active-duty U.S. military members that if they follow orders to strike drug-smuggling boats they might be committing illegal acts and could be prosecuted later. He said troops “may find out down the road that they did something that is illegal” because the policy comes from “the whims of a president.” A sitting U.S. Senator and former Navy pilot is on national television: - Questioning the legality of ongoing counter-narcotics ops - Telling sailors, pilots, and drone operators to second-guess their chain of command in real time - Implying the Commander-in-Chief is issuing potentially criminal orders This is how you erode good order and discipline. This is how you get hesitation in the cockpit or on the bridge when seconds matter. This is how you politicize the uniform and hand cartels a propaganda win. Imagine if a Republican senator said this about Biden’s Yemen strikes. The same media praising Kelly’s “courage” would be screaming “insurrection” and “undermining the military.”

Sen. Mark Kelly (D-AZ) said he no longer believes the three branches of government are equal: “I think Republicans in Congress have ceded their constitutional power, their authority to this White House. Very few of them will stand up to this president.” Sen. Kelly, who was censured by Defense Sec. Pete Hegseth over the retired Navy captain’s comments to service members to “refuse illegal orders” in a video posted to social media in November, said the move is “about stifling people’s speech.”
