Police don’t determine who is at fault, insurance companies do. I filled out plenty of accident reports as a police officer and I never put down who was at fault..

Then why did Kyle say his accident report says he's at fault?

That’s just the officers opinion which he is entitled to. He didn’t witness the accident so he’s only relying on what both drivers tell him. What if one driver was injured and unable to answer any questions. If it goes to trial a judge or jury will decide not the cop.

The Tesla would record everything about the incident. All anyone would have to do is get a hold of those records.
