Lady to officer: “Officer, I have no weapons, contraband, or open containers on my person or in my automobile.” Cop: “Can I search your car?” Lady to officer: “Only if you have probable cause or a search warrant pursuant to the federal 4th Amendment.” Note: the officer was not certain of what was passed off to her son; Officer had no articulable facts to suspect drugs. Officer can’t fish for probable cause in order to justify anything (including the stop or detention) as probable cause must exist before the stop or detention. Cop: “What was the guy’s name you gave the cup to?” Lady to cop: “Officer, I respectfully decline to answer that question pursuant to my federal 5th Amendment right.” After saying the above, every other question by the cop could have been responded with: “I invoke my 5th Amendment right to not answer that.” You see, when the government neutralized the Black Panther Party for Self-defense (BPP), they also neutralized Blacks of her type to learn and know the law and her rights. Law is not that hard to teach. Not at all. However, absence of the BPP is no excuse not to learn law on one’s own. That’s an individual duty or responsibility. The woman was talking too much and she let the officer get to her emotionally, thus unnecessarily shouting (out of anger and frustration). The officer was obviously fishing in order to hook her. He was also trying to provoke her with the “crack” question which was in fact racist (as 80% of Black Americans who did cocaine preferred crack over powder which is why the federal sentencing guideline for crack cocaine was 100:1 before Obama got it reduced to 17:1). The number one thing Black Americans need to know in these police interactions is to: (1) always keep calm (it’s just a game and officers are doing their job; it’s how they get paid), (2) keep your words civil, respectful and brief (and use legalese if it is known), and (3) invoke all constitutional and statutory rights, privileges, and immunities (state and federal). If all three required documents (driver license, proof of registration, and proof of auto insurance) are possessed and one is free of weapons, contraband, and open containers (liquor, alcohol), and follow the educational information supra, things should go pretty smoothly. The less one speaks, the better things will go. Too often, emotions get the best of way too many Black American motorists causing matters to unnecessarily escalate. Streets are not courtrooms. Know the difference. Knowledge acquired and applied is power. 😊
