In the United States, Living Trust > living wills with a "testamentary trust". Here's why: Wills must go through PROBATE in the COURT system first, BEFORE the "testamentary trust" takes effect. If you try to bypass the court or skirt the (greedy, corrupt) system in this instance, the "testamentary trust" is NOT put into action and is NOT funded. Meaning your family will NOT be protected or taken care of as you intended. Trusts do Not have to go through the long, stressful probate process/system. Because the Trust/Trustee(s) become the owner(s) of the assets, the court doesn't get to put any hands in the cookie jar. The Trust can have specific timelines and terms for disbursement or use of its assets, ensuring your final wishes are upheld without the interference of corrupt, inefficient Court systems (unless someone named or not named in the trust tries to contest it and attempts to take it to court, which is a whole different situation).
