Next time just don't test, drink water and buy time to lower the BAC %. Even though the law states that if you refuse an alcohol/drug test you're presumed guilty. Technically, refusing a test is not the same as being intoxicated. Assuming a person is intoxicated because they refuse a test is faulty logic because it still lacks the scientific basis as proof of impairment. Which I would appeal. "Refusing" a test is one crime and although it is punishable as a "DUI" ( a different crime), it still is technically NOT "testing positive for intoxication". Better for the law to assume that you're "testing dirty" and not know WHAT you're on, then to test and give them undeniable proof that you're on cocaine. I don't like that the female officer tried to coerce Tony into a lie by asking Tony "have you had any head injuries" bc she was trying to trap him into giving an indirect admission or declaration that, if impaired had the potential to paint him as a liar and not just as someone possibly above the legal amount.
