Trump’s openly talking about invoking the Insurrection Act with zero insurrection in sight. He’s inventing chaos in Portland and Chicago, and even saying he’d use it if courts or local officials are ‘holding us up’. Wild how he didn’t bother using it during the actual insurrection on January 6.

To make it simple for everyone: The Posse Comitatus Act prohibits the usage of federal military forces to enforce domestic laws within the United States. However, there is an exception to the Posse Comitatus Act, known as the Insurrection Act, which allows the President to bypass Posse Comitatus in the event of insurrection. Mind you, the actions of Pritzker and Johnson over the last few months, openly engaging in rebellion and refusing to enforce the laws in Chicago, meet the legal criteria for “insurrection”, which is also extremely vague and essentially up to POTUS’ discretion. In conclusion, the Supreme Court confirmed that if Trump wants to send troops to Chicago, he will need to bypass Posse Comitatus by invoking the Insurrection Act. Meaning, that the only thing standing between Trump legally sending troops to Chicago, and any city he wants, is a public proclamation that he is invoking the Insurrection Act and a public warning for the insurrectionists to disperse, before sending in the troops. So until Trump publicly announces that he is invoking the Insurrection Act, he’s not allowed to send the troops in. But all he has to do is give the order. It takes two seconds. Trump has confirmed many times that he is willing to do this. Here he is on 10/6/2025 saying he will invoke the Insurrection Act if he has to.

Virginia passed a law dictating how January 6 must be taught in public schools. Federal prosecutors charged over 1,500 people for that day. Seditious conspiracy. Assault. Obstruction. The one charge never filed: insurrection under 18 U.S.C. § 2383. HB 333 passed 21-19 and heads to the governor’s desk. If a school covers the topic, teachers must call it an insurrection. Any other characterization violates the statute. Courts required proof. Classrooms require compliance.
