At present, the President appoints the Prosecutor General on the recommendation of the Judicial Service Commission, a body composed of the most senior judges in the land. But those same judges are the very persons before whom the Prosecutor-General's decisions will come, in trials, in bail applications, in reviews and in appeals. To have the judges who will adjudicate the prosecutor's cases also select the prosecutor is not a safeguard of independence; it is a structural conflict of interest written into the constitutional text. Hon. Ziyambi states that Parliament will now transmit the Constitution of Zimbabwe Amendment (No. 3) Bill (CAB3) to His Excellency President Mnangagwa for assent and signature. Once assented, the Bill will be gazetted and become part of the Constitution. He notes that the timing depends on how quickly the Bill is transmitted, adding that the President normally assents to Bills promptly upon receipt.

After ZANUPF’s resolution to extend President Emmerson Mnangagwa’s term of office from 2028 to 2030, the BBC spoke to Zimbabwe’s leading constitutional expert, Professor Lovemore Madhuku, who dismissed the proposal outright, stating that there is no legal or constitutional basis upon which such an extension can be effected. Professor Madhuku made the remarks in an interview attached below with the BBC’s Waihiga Mwaura.

Government has clarified that proposed amendments relating to presidential and Parliamentary term limits do not require a referendum, but must secure a two-thirds majority vote in Parliament to pass. Justice, Legal and Parliamentary Affairs Minister, Ziyambi Ziyambi said the legislative changes will follow Constitutional procedures set out for such amendments.
