EDUCATION • LAW • FACTS | NAWROCKI IN A PHYSICAL CONFRONTATION WITH CONSTITUTIONAL TRIBUNAL JUDGES! A MEETING WITH ŚWIĘCZKOWSKI AND KAPIŃSKI, THEN A SCUFFLE AT THE TRIBUNAL ENTRANCE. WHERE ARE THE LIMITS OF PRESIDENTIAL POWER? SNERR × ASTRA | EDUCATION • LAW • OSINT • FREE PEOPLE | OCTOBER 31, 2026 President Karol Nawrocki, the events of October 30–31 demand answers. You were involved in a scuffle at the Constitutional Tribunal entrance. Judges allege that you pushed Anna Korwin-Piotrowska. Video has emerged. Earlier, you met Bogdan Święczkowski and Zbigniew Kapiński. Were your actions lawful? Was a judge assaulted? Who caused the escalation? Evidence, not partisan declarations, must decide. FACT ONE: NAWROCKI MET ŚWIĘCZKOWSKI AND KAPIŃSKI. This was not a meeting with some undefined group of judicial representatives. The participants were Bogdan Święczkowski, President of the Constitutional Tribunal, concerning whom Anna Korwin-Piotrowska had issued an order for a one-month interruption of official duties, and Zbigniew Kapiński, First President of the Supreme Court. The order's legal effect is disputed. Kapiński joined the Supreme Court in 2022 on the recommendation of the KRS restructured after 2017, a contested appointment procedure. Nawrocki made him First President of the Supreme Court on May 27, 2026. This context matters. FACT TWO: JUDGE KORWIN-PIOTROWSKA DID NOT REJECT EVERY POSSIBILITY OF MEETING THE PRESIDENT. Citing safety concerns, she initially opposed entry, but later offered to meet Nawrocki inside without Święczkowski or Kapiński. Rooms were available. Why did the confrontation occur? Was a peaceful meeting attempted? What did the security officers do? FACT THREE: THE RECORDINGS SHOW A PHYSICAL CONFRONTATION. Footage published by Maciej Berek and the media shows Nawrocki forcing his way between people standing in the entrance. Judges allege that he pushed Anna Korwin-Piotrowska. Presidential representatives offer the opposite account, claiming that Nawrocki's bodily integrity was violated. Full CCTV, security records and witness testimony must be secured. Video must be assessed carefully, not converted into a partisan verdict. FACT FOUR: THE PRESIDENT HAS NO UNLIMITED RIGHT TO USE FORCE. Article 7 of the Polish Constitution requires public authorities to act on the basis of and within the limits of law; Article 10 establishes the separation and balance of powers; Article 126 requires the president to safeguard the Constitution while exercising his duties within the law; Article 173 guarantees the independence of courts and tribunals; and Article 195(1) protects Constitutional Tribunal judges' independence. No electoral mandate overrides these limits. Not every physical contact is a crime, but the head of state's conduct remains subject to scrutiny for legality, necessity and proportionality. FACT FIVE: VIOLATING A JUDGE'S BODILY INTEGRITY MAY HAVE CRIMINAL CONSEQUENCES. Article 222(1) of the Criminal Code covers violating a public official's bodily integrity during or in connection with official duties. Article 224(2) criminalizes using violence or an unlawful threat to compel an official to act or refrain from a lawful official act. Article 231 concerns abuse of powers or failure to perform duties to the detriment of a public or private interest. Any legal classification requires proof of all statutory elements. Guilt cannot be proclaimed without evidence and due process; equally, an investigation cannot be ruled out merely because the individual involved is president. FACT SIX: THE PRESIDENT DOES NOT ELECT CONSTITUTIONAL TRIBUNAL JUDGES. Article 194(1) gives that power to the Sejm. The Act of November 30, 2016, on the Status of Constitutional Tribunal Judges regulates the oath before the president and its legal effects. Nawrocki received the oaths of only two of the six judges elected in March 2026; the others took theirs in the Sejm. In its October 9 opinion, the Venice Commission stated that the president should promptly receive the oaths of duly elected judges without claiming the power to review their election. Its opinion is advisory but sets out important constitutional standards. The oath dispute requires a legal solution, not force. FACT SEVEN: THE ŚWIĘCZKOWSKI–SOCHAŃSKI DISPUTE IS A SEPARATE LEGAL MATTER. Anna Korwin-Piotrowska announced orders for a one-month interruption of official duties by Tribunal President Bogdan Święczkowski and Vice-President Bartłomiej Sochański, citing, among other provisions, Article 130 of the Law on the Organization of Ordinary Courts and relevant statutory cross-references. The Tribunal's existing leadership disputed the validity of those orders. Prosecutor General Waldemar Żurek also filed applications to lift judicial immunity. Each step must be assessed separately. Neither an immunity application nor the mere issuance of an order establishes criminal liability or conclusively settles legal validity. FACT EIGHT: KAPIŃSKI'S APPOINTMENT HISTORY MATTERS. He served as a judge long before the changes to the KRS, but was appointed to the Supreme Court in 2022 under the restructured Council's recommendation procedure. That procedure has been contested in case law. “Neo-judge” refers to the nomination process, not the entire career, and does not automatically invalidate every judicial act. His attendance at the meeting remains relevant. FACT NINE: THE CONSTITUTION PROVIDES FOR PRESIDENTIAL ACCOUNTABILITY. Under Article 145, the president may be held accountable before the Tribunal of State for violating the Constitution or a statute, or for committing a criminal offence. Bringing charges requires a motion by at least 140 members of the National Assembly and a resolution adopted by at least two-thirds of its statutory membership. That does not establish liability in this incident, but confirms that even the president is accountable. QUESTIONS FOR PRESIDENT NAWROCKI: Why did you consult Święczkowski and Kapiński before arriving at the Tribunal? What was agreed? Did you know Judge Korwin-Piotrowska's conditions for a meeting? Why did a scuffle occur? Did you personally push her or anyone else? What orders were given to security personnel? Will the full recordings be preserved? On what legal basis do you contest the status of judges elected by the Sejm? POLAND NEEDS AN INDEPENDENT FINDING OF FACTS, NOT COMPETING POLITICAL NARRATIVES. The Constitution binds the president, Parliament, government, prosecutors, police and judges. An electoral mandate cannot enlarge constitutional powers. Presidential security cannot replace legal procedure. A constitutional dispute must never be settled by unlawful force. NO PRESIDENT STANDS ABOVE THE CONSTITUTION. EVERY ALLEGATION REQUIRES EVIDENCE, EVERY EXERCISE OF POWER A LEGAL BASIS, AND EVERY INSTITUTION RESPECT FOR ITS CONSTITUTIONAL ROLE.

Jetlag? A może nowa technika polityczna?

Panie Leśkiewicz, arogancie przekroczyliście dziś wszystkie czerwone kreski.

Ale wstyd że mamy takiego prezydenta
