The question is if you/me/anyone/the jury would send a person to death IF (1) there isn’t enough substance to convince a jury about ’guilt beyond a reasonable doubt’ AND (2) there’s no alternative assassin presented. Hopefully the answer is ’no’ (because that could be you/me/anyone/the jury sitting in Tyler Robinson’s chair). My point is that the trial is about Tyler Robinson’s guilt.
