Gary isn't the killer, there's more to that scene than we've seen. He might have picked up the pole then saw Theo's body. Thence his anxiety. Hopefully there's not much longer until the truth is revealed because this murder mystery has dragged on long enough.

I think Gary & Sarah came across Theo dead in the flat, thought Todd had killed him, and started covering up for him - Gary pushed his body off the scaffolding to make it look like an accident & Sarah disposed of evidence.
