An hour ago, I was on South Africa’s public broadcaster, the SABC News News discussing the implications of Zimbabwe’s new law, Constitutional Amendment Bill No. 3, which came into effect two days ago. The amendment extends President Emmerson Mnangagwa’s term of office by an additional two years to 2030, removes the direct election of the President by citizens and transfers that responsibility to Parliament, and effectively removes the elections that had been scheduled for 2028. We also discussed what these changes mean not only for Zimbabwe but for the entire region, particularly South Africa, which has borne the brunt of migration from Zimbabwe, both legal and illegal, driven largely by the country’s prolonged economic and political crises. What happens in Zimbabwe never stays in Zimbabwe. Political instability, economic decline, and democratic backsliding inevitably have consequences for neighbouring countries. That is why Constitutional Amendment Bill No. 3 is not merely a Zimbabwean issue; it is a regional issue with far-reaching political, economic, and social implications.

The problem we have is people stuck with the image of a Zimbabwe OF LONG AGO… South Africa is far ahead of Zimbabwe, it has always been… anyone trying to draw comparisons between the two countries is just confused… That said, Zimbabwe is developing & growing under President Mnangagwa, and because of that, don’t expect anyone to successfully mobilise people against him… and most importantly, THERE IS NO Zimbabwean in Zimbabwe or outside who has more political capital that President Mnangagwa, NONE…

Two cases which were brought before the Constitutional Court of Zimbabwe challenging Constitutional Amendment Bill No. 3 (CAB 3) have been struck off, NOT dismissed. CAB 3, which seeks, among other things, to extend President Emmerson Mnangagwa’s term of office and change the method of electing a president from direct election by citizens to election by Parliament, requires two referendums in law, but the ZANUPF faction sponsoring it wants to avoid a referendum. The Constitutional Court struck both cases off the roll this morning. It is important to understand that the cases were not dismissed on their merits. Rather, the Court held that the issues raised could not originate and be determined solely by the Constitutional Court and should first be ventilated in another forum, High Court. Professor Lovemore Maduku, who is arguing the cases, has indicated that they will now proceed to the High Court. Should the applicants fail to obtain the relief they seek there, the matters will inevitably return to the Constitutional Court on appeal. Many lawyers have described the Constitutional Court’s decision as an example of constitutional avoidance. In their view, the Court has declined to confront what has become a highly contentious constitutional question, preferring instead to defer consideration of the substantive issues. A central argument in the war veterans’ challenge, led by Professor Madhuku, is that Constitutional Amendment Bill No. 3 was discussed and approved by Cabinet, which included President Mnangagwa, the two Vice Presidents, and Cabinet ministers. Professor Madhuku argues that because President Mnangagwa stands to benefit directly from provisions extending his term of office, he should not have participated in deliberations on the amendments. According to the argument, the Constitution prohibits public officials from participating in decisions in which they have a direct personal interest. However, the Constitutional Court did not determine the merits of that argument, ruling instead that the matter should be heard elsewhere first. The legal battle is therefore far from over. It now moves to the High Court and, whatever the outcome there, is likely to find its way back to the Constitutional Court for a final determination.

WATCH | An affiliate member of Boys Dza Mdara says that Resolution Number One argues President Mnangagwa is loved by the people and should remain in power until 2030, even though the Constitution limits his term to 2028. Using the same reasoning, he claims that Paul Tungwarara is also loved by the people and should be co-opted into the ZANU-PF Central Committee. This argument goes against the ZANU-PF Constitution, which does not allow such a move.

Is he saying a monarchy is better than a Democracy or Constitutional Republic? Israel is a Democracy. Ambassador Barrack, like some other admin officials, has been infected with the Arab money virus that clouds judgement.

The Zimbabwean Parliament has adjourned until tomorrow. This is ZANUPF Member of Parliament Perseverance Zhou. This is the quality of debate that unfolded this afternoon in Zimbabwe’s Parliament as MPs debated the controversial Constitutional Amendment Bill No. 3, which seeks to extend Mnangagwa’s term of office to 2030. It was a bootlicking festival led by the President’s most enthusiastic sycophants. In this video, she compares Emmerson Mnangagwa to French football superstar Kylian Mbappé and argues that Mnangagwa should not step down in 2028 when his term of office ends. Using a football analogy, she suggests that Mnangagwa should not be stopped because he is already in the 18-yard box and close to scoring. This is what Zimbabwe’s constitutional debate has been reduced to. This is President Emmerson Mnangagwa of Zimbabwe saying that he has no desire to do more that 2 terns in office, that was in January 2018 talking to Richard Quest on CNN. It is a public secret that the Third Term movement is already in motion. What you need to know is that a Third Term at law is illegal for President Mnangagwa, it is unconstitutional! The constitution of Zimbabwe clearly states that to remove presidential term limits, you must have a referendum first. Even if that referendum happens and voters agree to the removal of term limits, the current President can’t benefit from such a move, it will be illegal. Only his successor can benefit. Sadly there is an illegal and unconstitutional precedent that was set, Chief Justice Luke Malaba is currently in his position illegally and unconstitutionally, they broke the constitution by giving him another term. The constitution was clear that the current Chief Justice couldn’t benefit from a change of the law, it would only benefit his successor. So be prepared for another constitutional violation, President Mnangagwa’s supporters have already pushing for a Third Term, and knowing Zimbabweans and Zimbabwe, he will get it the same way Malaba got back illegally and unconditionally!
