Legal experts have repeatedly stated that a New York mayor would likely lack authority to execute an ICC warrant against a visiting foreign head of government. Even Mamdani himself has acknowledged that he does not know whether he has that authority and says he is consulting the city’s legal department. It is true that the ICC has issued an arrest warrant for Benjamin Netanyahu. However, it is not true that the Mayor of New York clearly has the legal power to execute that warrant. Under current U.S. law, enforcement of international arrest warrants raises federal constitutional, diplomatic, and immunity issues.
