Well, that’s second degree murder - unless by some miracle the shooter survives. A good lawyer can probably get it down to voluntary manslaughter, but you can’t kill someone who isn’t actively threatening your life at that specific moment in time.

On January 18th, 2016, unarmed Daniel Shaver was shot to death by officer Philip Brailsford in Mesa, Arizona. There had been reports that he pointed a rifle out of the hotel window. In the full video, which you can look up as I won't post it, Shaver pleads for his life while at gunpoint. The officer makes ridiculous demands, which amount to a game of twister for his life.
