They should’ve talked to him first regardless of any property lines or whose fence it was. Common courtesy.

Was the fence directly ON the property line? Was it on the neighbor's side of the property line? Was it on TikToker's side? Legally, this is where the conversation begins.

I think the crazy people have always been here, it’s that now the democrats have said the crazy behavior is ok, go for it, call it protesting.

Sue the contractor for taking down your fence without approval, on your property. Contractor should have checked property lines to verify he had owner authorization before removing. What if they had chosen to put up a 4 ft fence, or a metal fence that is see through? It shouldn’t have been removed. It shouldn’t be your neighbors option on replacement choice.

Get a land surveyor to stake the corners going off your lot's plat (properly finding the corners for your property). A good land surveyor will confirm corners with other lots, by the front corners of the properties, usually. This guy needs to have the neighbor's side edge of posts in the ground that were left shot in. Surveyor will add picket width extension for wood fences (if pickets went toward neighbors). If that line is on "your property"... that's ammo in a case for wrongdoing (not legal advice but just saying from a surveying perspective). Regardless, folks - don't treat your neighbors like this. This is becoming more and more common because all of you are becoming more and more petty and non-communicative. Talk to your neighbors! I'm a manager in land surveying and this is a trend we're seeing more and more of (to an alarming degree). Don't be a bad neighbor over a couple inches and a fence. Half a foot, go for it, but if it's like 1-3"... just please communicate for an agreement/understanding before you attempt adjustments like this. Especially for those that have bought in high demand areas over last 5 years... the fences can be off wildly especially if there's a retaining wall between properties. There's a change the distance off-property line is on the original survey at closing, have fun saying anything. While I'm on it... if you have a land surveying crew digging up your irons to aid in a neighbor's survey, do the following - 1) Thank them, they just helped you find your corners and for other surveyors, 2) Realize this is how land surveyors check accuracy of a lot's placement. IF they don't do this - they are LIARS. Corners have to be confirmed with adjoining (neighboring) properties by current deeds. This is a crucial step, cannot overstate it. Also, don't be mean to land surveyors. In recent years, threats against field crews have gone up merely out of ignorance. People don't know what land surveyors do although it's an integral part of land ownership. Pretty fundamental... even Biblical. These threats are even life-threatening. Okay? So just keep a cool-head and discern people when they're on/near your property. Avoid court at all costs!

It may have been an innocent mistake in which they didn't realize the fence was on his property line. Or he himself could be mistaken about the property line as well. In any case err on the side of good faith and take the win on the new fence until further info is given.

The survey is required for the fence. The fence must be on the other person’s property. He has the right to replace his fence.
