And then, his own attorney could not locate him, and wasn’t given any information on his condition. Tuesday, his criminal complaint was unsealed, he went to court, and a judge ordered his release. The government then stepped in to appeal that order, and keep him detained… claiming he’s “a danger to the community if released.” Because he drove his car “close to the bodies of the ICE agents” after attempting to flee. Federal agents claim this was a “targeted stop” and that they opened fire in self-defense after he “weaponized” his car. But, a civilian witness, with dashcam footage, says something very different… and her account matches Hernandez’s. She says agents were already surrounding his car, striking his window… when a single shot rang out. The car THEN began to back up, trying to leave, and multiple shots followed in rapid succession. He did not try to hit agents with his car… he only reversed AFTER a gun was fired at him. And in the video, you can see the agent does, in fact, have his gun pulled, aiming at Hernandez, before he reverses. Hernandez told his attorney the same thing from his hospital bed… that he pulled over, handed over his license, asked to call his wife… an agents fired their weapon, and THEN he drove away in fear. Two separate accounts. Same sequence. ICE shoots first… then claims self-defense. The witness also says agents were pointing guns into active traffic, at random cars, putting everyone on that road at risk… Again, showing that ICE agents are the real danger to communities. But, what makes this more alarming is the custody timeline… Hernandez was shot, hospitalized, transferred into federal custody, disappeared from contact with his attorney, then reappeared in court where a judge ordered his release, only for the government to immediately appeal and continue fighting his detention. That raises serious questions about due process, and transparency in federal custody, after a use-of-force incident. Because at every stage, the “facts” being asserted by DHS are being directly challenged by eyewitness accounts, physical footage, and now, even the procedural outcome in court.
