The Hon’ble Finance Minister has appealed for ethical practices — but do GST officers uphold the same values? 🚨 Procedural Irregularities in GST Registration: SCN Issued on 30th Day Contrary to CBIC Instruction No. 03/2025-GST 🚨 Despite CBIC's clear instructions aimed at ensuring a smooth and non-discretionary registration process, recent practices reflect the opposite. Here's a real example that deserves attention: 🔹 1️⃣ SCN Issued on the 30th Day The Show Cause Notice (SCN) was issued exactly on the 30th calendar day — just before the close of business hours. No prior verification or interaction was initiated in the preceding 29 days. 📌 This timing clearly blocks deemed approval of GST registration (30 days timeline) and appears to be a deliberate delay — defeating the purpose of a time-bound system. 🔹 2️⃣ No Physical Verification Conducted As per CBIC instructions 03/2025, if no verification is done and no SCN is issued within 30 days, the registration is automatically approved. 📌 Here, no site visit or verification took place for 29 days. The SCN was issued last-minute, without justification — a procedural lapse that erodes taxpayer confidence. 🔹 3️⃣ Ownership Documents Demanded in a Rented Premises The SCN asked for documents proving ownership of the premises, even though the place was rented. 📌 CBIC clearly states (Para 6) that a rent agreement + lessor’s utility bill is enough. Requiring ownership documents violates this guideline and adds unnecessary hurdles. 🔹 4️⃣ Aadhaar & PAN of Landlord Demanded The SCN also sought Aadhaar and PAN of the landlord, even though the applicant is a tenant. 📌 No rule or CBIC instruction supports this demand. It overreaches legal authority, raises privacy concerns, and lacks any statutory basis. 🔹 5️⃣ Electricity Bill 'Duly Verified by Issuing Authority' The SCN insists the utility bill must be “duly verified by the issuing authority.” 📌 This is vague and practically unfeasible — DISCOMs don’t verify bills for GST purposes. CBIC only requires a copy as supporting proof, not a formal attestation. 🔹 6️⃣ Undermining CBIC’s Objective of Simplification CBIC clearly states that genuine applicants must not be harassed and the process should be hassle-free. 📌 Yet this SCN contradicts that goal by adding arbitrary conditions and turning a streamlined process into a bureaucratic ordeal. 🛑 Conclusion: This is a textbook case of procedural misuse — going against both the spirit and letter of CBIC instructions.
