Florida Statute 776.041 treats someone who provokes or escalates a confrontation as the initial aggressor, stripping stand-your-ground protections and imposing a duty to retreat using all reasonable means short of deadly force. She escalated the situation by leaving a place of safety (her car) pre-armed. Therefore, she is the aggressor and has duty to retreat.. which she had ample time to do. This is why brandishing a weapon is always a bad idea. Had she kept it concealed, pulled and fired.. maybe she'd have a case for it, but slim at that with it just being a verbal altercation.

She started the violent confrontation by exiting her vehicle with her firearm drawn. She did not draw her gun after anything he did. You have really fallen off. If he was armed, HE could’ve shot her the moment she did that. Walking in her general direction is not a deadly force threat.

If I have a firearm aimed at someone and they persist in advancing toward me, it indicates that this individual is highly dangerous maybe crazy. They are disregarding every warning cue to stop or retreat, which suggests they might attempt to attack or even kill me if the gun were to dropped or misfire.
