Not for a moment will I ever say that we must not give premium to innocence. Democracy is nurtured, its core values blossom, and human rights are taken at a high pedestal when we believe in innocence till the guilt is established. Therefore, I must not be misunderstood as casting aspersions on any individual. But then, in a democratic nation, purity of its criminal justice system defines its direction. Investigation is required. No investigation under law is in progress at the moment. Because for a criminal investigation, the initiation has to be by an FIR—First Information Report. It is not there. It is the law of the land that every cognizable offence is required to be reported to the police. And failure to do so—failure to report a cognizable offence—is a crime. Therefore, you all will be wondering why there has been no FIR. The answer is simple. An FIR in this country can be registered against anyone—any constitutional functionary, including the one before you. One has only to activate the rule of law. No permission is required. But if it is judges—FIR cannot be straightaway registered. It has to be approved by the concerned in judiciary. But that is not given in the Constitution. The Constitution of India has accorded immunity from prosecution only to the Hon'ble President and the Hon'ble Governors. So how come a category beyond law has secured this immunity? Because the ill-effects of this are being felt in the mind of one and all. Every Indian, young and old, is deeply concerned. If the event had taken place at his house, the speed would have been an electronic rocket. Now, it is not even a cattle cart. #RajyaSabha

It wasn’t justice for the victims and their families. If you rape girls, brandish a knife, film it for sport - premeditated - you should go to prison. For a very long time. What message does this send to rapists? This insulting lenient ‘sentence’ must be overturned. The suitability of the judge who made this perverse decision must be reviewed by the Lady Chief Justice. It shows the rot that’s set in our criminal justice system. The Justice Secretary’s plan to create a softer route through the criminal justice system for those under 25 is mistaken. It will only encourage more of this. And David Lammy proposes raising the age of criminal responsibility to 14. 🚨 Cabinet has today approved a draft law that would significantly rewrite the Constitution, allowing President Mnangagwa to stay in office beyond 2028 and changing how elections are run. Next, the draft Constitutional Amendment No. 3 Bill will be gazetted by the Speaker of Parliament. It will then be tabled in Parliament after 90 days of public debate. If passed, it would amount to one of the biggest constitutional changes in years. Here are the key changes: 🔴 How the President would be chosen The Bill removes the current system of directly electing the President by popular vote. Instead, the President would be elected by Parliament. To win, a candidate must secure a majority of parliamentary votes. 🔴 Longer terms for the President and MPs The Bill increases the term of office for both the President and Members of Parliament from five years to seven years. 🔴 Changes to the Attorney-General’s office Under the Bill, anyone appointed as Attorney-General would need to meet the qualifications required of a Supreme Court judge. 🔴 A bigger Senate The Bill allows the President to appoint ten more senators, increasing the total number from 80 to 90. 🔴 Control of elections Responsibility for voter registration and the voters’ roll would move from ZEC to the Registrar-General. A new Zimbabwe Electoral Delimitation Commission would be set up to take over the task of drawing constituency and ward boundaries from ZEC. 🔴 Judicial appointments The Bill removes the public interview process for judicial appointments. Let me take incidents that are most recent. They are dominating our minds. An event happened on the night of the 14th and 15th of March in New Delhi, at the residence of a judge. For seven days, no one knew about it. We have to ask questions to ourselves: Is the delay explainable? Condonable? Does it not raise certain fundamental questions? In any ordinary situation—and ordinary situations define rule of law—things would have been different. It was only on 21st March, disclosed by a newspaper, that people of the country were shocked as never before. They were in some kind of limbo, deeply concerned and worried at this explosive, alarming expose. Thereafter, fortunately, in public domain, we had input from an authoritative source: the Supreme Court of India. And the input indicated culpability. Input did not lead to doubt that something was amiss. Something required to be investigated. Now the nation waits with bated breath. The nation is restive because one of our institutions, to which people have looked up always with highest respect and deference, was put in the dock. It is now over a month. Even if it is can of worms. Even if there are skeletons in the cupboard, time to blow up the can. Time for its lid to go out. And time for the cupboard to collapse. Let the worms and skeletons be in public domain so that cleansing takes place. #RajyaSabha

Yesterday, I appointed Ivy Lee as the inaugural Director of the Office of Victim and Witness Rights. The formation of this new department signals a major step forward for victims, advocates, and survivors. It strengthens our pursuit of justice and transparency for victims who often feel ignored in the criminal justice process, serving as both a safety net and an accountability partner for the City. Thank you to Supervisor Catherine Stefani for spearheading the creation of this office and all those committed to making it a success. As we work to ensure that victims and witnesses of crime receive the comprehensive support they deserve, I am confident Ivy’s extensive experience in civil rights law and her commitment to justice will carry this department and our policies forward. Let’s continue our commitment to safety, justice, and healing for all San Franciscans together.

The police are only authorised to use firearms if their own lives are in imminent danger, or if there is absolutely no other way to apprehend a serious offender. However, none of those conditions was applicable in this instance…this is nothing less than murder…the Supreme Court has explicitly ruled that in any case of death resulting from an encounter, the registration of an FIR and an investigation by an independent agency are mandatory…while we welcome the Chief Minister’s direction for a judicial inquiry, it does not address or establish criminal accountability…I hope the court appoints the CBI so that an impartial investigation can ensue.
