Open Letter to the International Community, Human Rights Organizations, and the United Nations Subject: Urgent Appeal to Protect the Pashtun National Jirga and Address State-Sponsored Terrorism in Pakistan To the Global Community, United Nations, and All Human Rights Organizations, We, the Pashtun Tahafuz Movement (PTM) United States, are writing this urgent open letter to bring to your immediate attention the severe state-sponsored repression against the Pashtuns in Pakistan. This grave situation requires global action to stop the escalating violence and ensure the protection of basic human rights. On October 11, 2024, the Pashtun National Jirga, a historic assembly rooted in Pashtun tradition for peaceful decision-making and conflict resolution, is scheduled to take place in Pakhtunkhwa. This gathering will unite Pashtuns from across the region to peacefully advocate for their rights and protest against state violence. However, in an alarming and oppressive move, the Pakistani state forces have confiscated the designated Jirga ground, turning it into a militarized zone. Armed security forces have built posts and established a strong presence in the area to prevent the peaceful assembly from taking place. These aggressive actions reflect the state's intent to violently disrupt the Jirga, intimidate participants, and silence the voices of the Pashtuns. In addition to this, the communication channels with Jirga organizers have been severed, isolating them from the outside world and making them even more vulnerable to state repression. The lives of those planning to attend are at immediate risk, and their fundamental right to peaceful assembly and free speech is being brutally denied. This confiscation of the Jirga ground and militarization of the space is not an isolated act but part of a broader, long-standing pattern of state-sponsored terrorism aimed at erasing Pashtun voices and suppressing their peaceful demands for justice. 50 years ago yesterday: U.N. General Assembly adopts initial draft resolution declaring Zionism to be “a form of racism.” U.S. Ambassador Daniel Patrick Moynihan delivered this historic speech when the infamous act was ratified on Nov. 10, 1975: 🇺🇸 “There appears to have developed in the United Nations the practice for a number of countries to combine for the purpose of doing something outrageous, and thereafter, the outrageous thing having been done, to profess themselves outraged by those who have the temerity to point it out, and subsequently to declare themselves innocent of any wrong-doing in consequence of its having been brought about wholly in reaction to the “insufferable” acts of those who pointed the wrong-doing out in the first place. Out of deference to these curious sensibilities, the United States chose not to speak in advance of this vote: we speak in its aftermath and in tones of the utmost concern. There will be new forces, some of them arising now, new prophets and new despots, who will justify their actions with the help of just such distortions of words as we have sanctioned here today. Today we have drained the word “racism” of its meaning. Tomorrow, terms like “national self-determination” and “national honor” will be perverted in the same way to serve the purposes of conquest and exploitation. And when these claims begin to be made — as they already have begun to be made — it is the small nations of the world whose integrity will suffer. And how will the small nations of the world defend themselves, on what grounds will others be moved to defend and protect them, when the language of human rights, the only language by which the small can be defended, is no longer believed and no longer has a power of its own? There is this danger, and then a final danger that is the most serious of all. Which is that the damage we now do to the idea of human rights and the language of human rights could well be irreversible. The idea of human rights as we know it today is not an idea which has always existed in human affairs, it is an idea which appeared at a specific time in the world, and under very special circumstances. Not for a moment will I ever say that we must not give premium to innocence. Democracy is nurtured, its core values blossom, and human rights are taken at a high pedestal when we believe in innocence till the guilt is established. Therefore, I must not be misunderstood as casting aspersions on any individual. But then, in a democratic nation, purity of its criminal justice system defines its direction. Investigation is required. No investigation under law is in progress at the moment. Because for a criminal investigation, the initiation has to be by an FIR—First Information Report. It is not there. It is the law of the land that every cognizable offence is required to be reported to the police. And failure to do so—failure to report a cognizable offence—is a crime. Therefore, you all will be wondering why there has been no FIR. The answer is simple. An FIR in this country can be registered against anyone—any constitutional functionary, including the one before you. One has only to activate the rule of law. No permission is required. But if it is judges—FIR cannot be straightaway registered. It has to be approved by the concerned in judiciary. But that is not given in the Constitution. The Constitution of India has accorded immunity from prosecution only to the Hon'ble President and the Hon'ble Governors. So how come a category beyond law has secured this immunity? Because the ill-effects of this are being felt in the mind of one and all. Every Indian, young and old, is deeply concerned. Investigation is required. No investigation under law is in progress at the moment. Because for a criminal investigation, the initiation has to be by an FIR—First Information Report. It is not there. It is the law of the land that every cognizable offence is required to be reported to the police. And failure to do so—failure to report a cognizable offence—is a crime. Therefore, you all will be wondering why there has been no FIR. The answer is simple. An FIR in this country can be registered against anyone—any constitutional functionary, including the one before you. One has only to activate the rule of law. No permission is required. But if it is judges—FIR cannot be straightaway registered. It has to be approved by the concerned in judiciary. But that is not given in the Constitution. The Constitution of India has accorded immunity from prosecution only to the Hon'ble President and the Hon'ble Governors. So how come a category beyond law has secured this immunity? Because the ill-effects of this are being felt in the mind of one and all. Every Indian, young and old, is deeply concerned. Last week, for the first time in the Romanian Parliament, the words "I am Taiwanese" were spoken, both in Hokkien and Mandarin, the most widely spoken languages in that country. They were spoken to assert a simple and firm truth: We cannot afford another nation martyred by a dictatorial regime, following the fate of Ukraine. We cannot allow Taiwan to become a target of political expansionist ambitions, economic and societal control, of a regime that does not respect human rights domestically and the rules of good neighborliness and collaboration internationally. My statement is a continuation of the efforts I make as co-chair of the Interparliamentary Alliance on China (Inter-Parliamentary Alliance on China (IPAC)) and member of the Formosa Club (The Formosa Club) to ensure that the Indo-Pacific region is not monopolized by an undemocratic player like the People's Republic of China, a player that has proven to prioritize the repressive interests of its party elite over the legitimate interests and aspirations, rights of its own citizens, national and religious minorities, and neighboring nations. This was abundantly proven this weekend when 10 Chinese warplanes crossed the median line separating the territorial waters of the People's Republic of China from those of Taiwan, in a blatant act of provocation. Below is the text of my statement from the Romanian Parliament on Wednesday, June 7, 2023: -------------------------- Dear colleagues, "Wǒ shì táiwān rén!" "Góa sī Tâi-oân lâng!" These two phrases, spoken today for the first time in the Romanian Parliament, mean "I am Taiwanese!", in Mandarin and Hokkien, two of the languages spoken in Taiwan. Through these words, the citizens of this country affirm their identity, an identity they have the right to have and to express freely. Identity is the key to a free and diverse society, where each individual has the right to express their culture, values, and aspirations. In Taiwan, this identity is flourishing, fueled by a rich history and a people dedicated to the values of democracy, freedom, and respect for human rights. Let's not forget that, like any free people, the Taiwanese identity is not defined by political conflicts or demarcation lines on the map, but by the people who call this island home. People who, despite pressures and challenges, continue to fight for democracy, civil rights, and freedom. And that's why, two weeks ago, I had the distinct honor of representing Romania at the inaugural meeting of the Formosa Club, a gathering of over 30 parliamentarians and MEPs who support Taiwan. As a member of the Romania-Taiwan friendship group, I witnessed a historic meeting that reaffirmed the importance of peace and stability in the Taiwan Strait, an area of crucial importance for global security and prosperity. In this forum, we conveyed a clear and powerful message: any existing disputes between the two sides of the Taiwan Strait must be addressed through peaceful means and the status quo should not be unilaterally changed, against the will of the Taiwanese people. Any aggressive and reckless behavior not only harms reconciliation efforts but also unnecessarily escalates tensions in the region, an action we firmly oppose. Taiwan is an indispensable member of the international community, with much to offer in a range of fields. Taiwan's continued exclusion from international organizations is not in line with global interests. We consistently support Taiwan's meaningful involvement in meetings, mechanisms, and activities of multilateral institutions, including but not limited to the World Health Organization, the International Civil Aviation Organization, the International Criminal Police Organization, and the United Nations Framework Convention on Climate Change. Taiwan is a key partner and a democratic ally in the Indo-Pacific region. Every democracy, including Taiwan, has the right to develop comprehensive relationships with other countries to advance the common interests of their peoples and to promote the values of freedom, democracy, human rights, and the rule of law. We underline the urgent need to strengthen our cooperation with Taiwan, such as through the establishment of trade, investment, and sectoral agreements, to enhance the resilience of our supply chains and our democracies. We reiterate our intention to continue standing with Taiwan and to do everything in our power to ensure its democracy, while strengthening the close ties between Taiwan, the EU, other European democracies, and transatlantic countries, to defend our common values and the global liberal democratic order. I invite you to join this cause, to support Taiwan's meaningful participation in international institutions, and to recognize its value as a member of the international community. It is time to strengthen our cooperation with Taiwan, to establish trade, investment, and sectoral agreements, to enhance the resilience of our supply chains and our democracies. The right to development, to promote the values of freedom, democracy, human rights, and the rule of law is not a privilege, but a fundamental right. These are not only Taiwan's values, but also our values, Romania's values, Europe's values. In conclusion, I want to assure you that I will continue to stand with Taiwan and do everything possible to ensure its democracy, while strengthening the closer ties between Taiwan, Romania, the EU, other European democracies, and transatlantic countries.
