Adv. Khumalo has cooked this questionable prosecutor adv Serunye straight to the wording of PRECCA, repeatedly telling him, "Look at the last part of section 21." He kept pressing the point that section 21 doesn't stand on its own , it takes you back to the actual offence in the Act. If the charge says there was a conspiracy to give gratification, then what was the offence they conspired to commit? That crucial element was missing from count one wh.ich is the main charge Then the Chair stepped in and reminded him that this wasn't a new issue. Right at the beginning, when he first raised his own queries, he himself asked, "to do what...?" showing he knew the charge needed that missing element. The Chair asked how he could have forgotten that when drafting the charge sheet. Eventually, he conceded that point. To top it off Adv. It is, ''that he came in in this and found a mess, and he tried to fix, he tried to help fix it. So now we know that the letter General Mkhwanazi told us about, which was allegedly written by an inmate, was real. It's only a matter of time before we learn whether the other allegations contained in that letter are also true ,especially those concerning the politicians it mentions, their alleged involvement in drug activities, to one of them being allegedly found at Mr Molefe's house on the day of the raid. Let's wait. In time, the full story behind that letter may come to light. One thing we do know about General Mkhwanazi is that he doesn't make statements simply for the sake of talking. When he raises an issue, he usually believes there is information to support it, and over time the facts often become clearer. The inmate who allegedly provided the letter also made claims about Cat Matlala allegedly funding the Minister's conference . And about alleged unauthorised night prison visits . Now, with today's hearing revealing allegations that Sgt Fannie Nkosi was also visited at night in prison by IDAC officials and was allegedly threatened by those officials, it raises further questions. Why Sergeant Nkosi? If those allegations are accurate, it could explain why General Mkhwanazi insisted on transferring Cat Matlala to Ebongweni Maximum Correctional Centre. The question the public will now want answered is, what were they allegedly looking for from Sgt Nkosi while he was in prison?🤦♂️🙆♂️😳
