As of today, August 1 2026, Texas officially classified Delta-8 (legal marijuana) and other hemp-derived THC products the same way it classifies heroin and LSD. Which means If you are caught with less than 1 Gram of marijuana, any trace amount up to 0.99 grams, it is a State Jail Felony which carries a mandatory sentence of 180 days to 2 years in a state jail facility, plus fines up to $10,000. Yeah that’s really fucked up. This is James Talarico fighting for all of us.
