My Statement on Conditions for the Use of Firearms by Police Officers I have seen debates, reactions, and expressions regarding my recent statement on the use of firearms by police officers. My statement was made contextually and consciously with clarity of mind based on the express provisions of the law. No leader, scholar, jurist, journalist, blogger, or opinion shaper has challenged me on the law. At my age, position, and experience, I cannot utter statements that are not supported by the Constitution and the law. Throughout my career, I have never, in my conduct or utterances, found myself on the wrong side of the law. Indeed the Sixth Schedule of the National Police Service Act, in Paragraph B(1), provides the conditions for use of firearms by the Police as follows: 1.Protecting the lives of officers or civilians 2.Self-defense against imminent threats of death or serious injury protection through justified force 4.Preventing the escape of felony suspects from lawful custody I ask all those who are spreading misinformation, disinformation, and fake news to challenge me on the law. Those who are saying I issued an order to the police should show where the order is. A mere restatement of the law as it exists cannot amount to giving an order to the police. The Police are mandated by law to operate within the constitutional framework, the statutes, and the departmental standing orders. In any case, I have no constitutional powers to give such orders; instead, I have a duty to support the police and to formulate policy recommendations to aid the application of law in the enforcement of law and order. Our police officers who are attacked by robbers, rioters, and arsonists—who have torched police stations, stolen rifles, burnt suspects alive, and burnt property worth millions of shillings, including courts —cannot be left helpless when they have been given the authority by the Constitution and the law to defend themselves, the citizens, and their property. The law is in black and white.

The success we have achieved in combating banditry across the country has been driven by intelligence-led operations, partnership with local communities, and adherence to the rule of law-not excessive use of force. The events of the past few days in Ang’ata Barikoi, which have resulted in the tragic loss of a police officer, injuries to civilians, destruction of property, and loss of livestock, are deeply unfortunate and unacceptable. This Tuktuk was stopped by NTSA and traffic police officers while carrying eight passengers instead of the recommended four on the Kisumu-Nairobi Road. Needless to say it was dangerously overloaded. I hope the cyclist, who fled the scene, will be made to face justice for his reckless behaviour. To all passengers, please don't encourage this kind of unsafe road behaviour by keeping quiet. Protest when you see a bus driver or a Tuktuk cyclist starting to overload. Let's stop risking lives on our roads. Remember that road safety is everyone's responsibility.

While at NTSA Headquarters in Upper Hill this afternoon, I spoke to Maurice, a customer based in Mombasa, who has been waiting for his digital number plate for a while now. Despite the number plate being ready for collection and a notification sent to him from NTSA - Nairobi confirming the same, unnecessary bureaucratic processes and red tapes have led to delays in dispatching the number plate. I have instructed officials at NTSA - Nairobi to fast-track the delivery process and ensure Maurice receives his digital number plate by Monday next week. There’s no scheme whatsoever to undermine Chief Justice Martha Koome or the Judiciary. What happened was a matter of three police officers assigned to the CJ who had been promoted and were leaving for training. Our CJ is one of the most-guarded public officers with 32 security personnel assigned to her. Even with the three officers proceeding for training, she will remain with 29 at her service.
