At the People’s Tribunal in Madrid, their testimonies became legal evidence as proof of Taliban’s state-led campaign of gender persecution. They survived the Taliban’s system of gender apartheid in Afghanistan and have dedicated their lives to ensuring the world understands what it means in practice: more than 200 decrees, laws and directives designed to exclude women and girls from education, work, public life and basic freedoms. This week, at the 5th Ministerial Conference on Feminist Foreign Policy, 28 governments made political commitments to support gender equality. Among them was to recognise the core elements of the Taliban’s regime of systematic gender-based oppression and domination. Now governments must take the next step and recognize it for what it is: gender apartheid as a crime against humanity under international law - both to hold perpetrators accountable and help prevent similar systems from taking root elsewhere. A few months ago, Afghan women came forward to share testimony for the People’s Tribunal for Women of Afghanistan. Their courage helped produce today’s judgment, which finds the Taliban responsible for gender persecution and operating an apartheid-like system of control over girls and women. The judgment also highlights a major gap. International law does not yet recognise gender apartheid as a crime. Afghan women made this moment possible and they want real action.
